Multiple designs are allowed in one design application only if the designs belong to the same set (usually used or sold at the same time).

• Licensing Fee: None.
• Annuity: From the 5th year onwards from the date of application, it will be paid year by year. The application fee includes annual fees for the first and second years. There is no annual fee for the third and fourth years, but the applicant needs to notify INPI for renewal in the third and fourth years. All subsequent annual fees must be paid within six months before the date corresponding to the year of application. Overdue annual fees can be paid within a 6-month grace period, and 50% of the annual fee of the current year is required to be paid as a penalty.

IMPI conducts formal and substantive examinations of utility model patent applications. There are three ways to submit an application to INPI: online application, mailing and submitting a written application to INPI in person. No matter which way the application is filed, the application date of the patent is the time when the patent applicant sends the complete patent application text to INPI. IMPI accepts only one independent claim in a utility model application. Applicants are required to pay the substantive examination fee within 3 months from the date of application. The time limit for responding to the Office Action Notice is 3 months from the date of issue, and can be extended 3 times (one month each time). The requirements for utility models are relatively loose, and they need to be novel and practical, but not inventive.

• Grant fee: The applicant needs to pay the granted fee within 2 months from the date of issuance of the granted notice. If it is overdue, it can resume after paying the recovery fee within a grace period of 4 months.
• annual fee:
  • via Paris Convention : the annual fee shall be paid year by year from the third year from the filing date, and the applicant shall pay all the annual fees calculated from the third year from the filing date after granted, and shall pay on the last day of the month in which the filing date is located.
  • PCT entry into the Swedish national phase: payable annually from the international filing date. The due date of the annual fee for the first three years is the last day of the month of the second anniversary of the international filing date, and it shall be paid at the same time when entering the national phase; if the time of entering the national phase is before the above deadline, it shall be paid within 2 months after entering the national phase pay. Subsequent annual fees shall be paid by the last day of the month in which the international filing date falls each year. The annual fee can be paid within a grace period of 6 months after the due date at the latest, subject to an additional 20% late fee.

• Authorization Fee: None
• Annuity: The annual fee is paid every 5 years. The overdue annual fee can be paid within a grace period of up to six months after the due date, and a 20% late fee will be paid at the same time. Pay within the first 3 months of the grace period with no late fees.

TURKPATENT only conducts formality examination and prior art search for utility model patent applications, and does not protect methods or chemical products. The search is only for novelty and industrial applicability, and there is no requirement for inventive step. The applicant shall submit the prior art search request within 3 months from the date of issuance of the acceptance notice.

10 years

For innovation patents that have ceased application on August 25, 2021, the innovation patents that have been applied for can still enjoy the corresponding 8-year protection period.

• Grant fee: The applicant shall pay the granted fee within 2 months after receiving the granted payment notice.
• Annuity: From the 3rd year from the filing date, the annual fee shall be paid year by year. For the application of PCT entering the national phase of Turkey, the maintenance fee before granted shall be paid. If the annual fee is overdue, it can be paid within a grace period of 6 months, and a 125% late fee will be paid at the same time.
