If the following situations occur 12 months before the patent application/priority date by the inventor, applicant or assignee:

• By correspondence, or publicly at national or international exhibitions

• Disclosure due to malicious disclosure by a third party

  The novelty grace period can be enjoyed, and the applicant needs to submit corresponding evidence support when submitting the application.

Reinstatement of priority is accepted on grounds of "due care."

• Grant fee: The applicant shall pay the granted announcement fee within 2 months after receiving the official notification.
• Annuity: The annual fee will be paid year by year starting from the third year (including the first-third year annual fee). Overdue annual fee can be paid within a grace period of 6 months, and a 20% late fee will be paid at the same time.

TURKPATENT only conducts a formality examination of the design patent application, and it can be authorized if it meets the novelty.

• Grant fee: should be paid within 3 months after receiving the granted notice
• Annuity: From the 5th year from the filing date, the annual fee should be paid before the filing date of each year. If the annual fee is overdue, the payment can be postponed to a grace period of 6 months, but a penalty of AUD 100.00 is required every month

• Authorization Fee: None
• Annuity: pay year by year from the third year from the application date, and the payment deadline for the annual fee is the end of the month corresponding to the application date. If the annual fee is overdue, it can be paid within a grace period of 6 months, and a late fee of 20.00 Euros should be paid at the same time.

• via Paris Convention : 12 months from earliest priority date.
• via Nationalization of PCT : 31 months from earliest priority date.

The novelty grace period of the year preceding the filing date/priority right is granted if:

• The disclosure was caused by a third party illegally obtaining patent information
• The disclosure resulted from a breach of confidentiality by a person who obtained the patent information directly or indirectly from the applicant
• The disclosure was made by a government agency or a person authorized by a government in the investigation of an invention
• Disclosure results from a public exercise of reasonableness by the patentee or designee, the original owner of both, or a person with the consent of one of the foregoing
• A one-year novelty grace period if the evidence is submitted prior to review if the first disclosure was made after December 30, 2018, by:
  • patentee or designee
  • Original right holder of the patentee or designee
  • A person with the consent of the original right holder of the patentee or designee

A novelty grace period of 6 months is available if:

• With the consent of the inventor, the invention is exhibited at a specific exhibition or used for the exhibition
• Use or disclose inventions after the above exhibitions

yes. It is possible to change the patent type from utility model to invention within 30 days of receiving the grant/rejection decision, and pay the corresponding fee.

10 years

OSIM only conducts formality examination of utility model patent applications. OSIM issues a search report within 6 months from the date of filing, and attaches relevant documents related to the prior art related to the novelty. The applicant may amend the patent application within 2 months from the receipt of the search report. The search report can be published at the time of grant or after grant at the request of the applicant/third party.

The initial period of protection is 6 years, which can be renewed twice, up to a maximum of 10 years.

• via Paris Convention : 6 months from earliest priority date.
• EU route: 6 months from earliest priority date.
• Hague Agreement route: 6 months from earliest priority date.

4-6 months

The novelty of the invention shall not be affected if the invention is disclosed directly or indirectly due to the following reasons within 6 months before the filing of the application:

• Practical testing and construction of machinery and instruments that the applicant needs to carry out in preparation for the invention
• The applicant or inventor exhibits at an officially held or recognized exhibition
• Malicious disclosure by third parties
